Disclosing Your Endorsements to Your Subscriber List Per FTC Guidelines

Let me first start off by saying I AM NOT A LAWYER, nor do I have any legal training in any way.  Now that I have gotten that out of the way, I would like to address an element of the new FTC rules for endorsements that go into effect on December 1st, 2009.

When I became aware of the new FTC rules for endorsements, I posed a question on a forum that I am a member of.  The question was how does one protect themselves and follow the FTC guidelines while still mailing to there list?  The question went unanswered, but many said that would get back to me.  I don’t think that many people know what to do in the case of the new FTC Guidelines.

FTC’s New Rules For Bloggers and Endorsements Of Products

The U.S. Federal Trade Commission announced on Monday, October 5, 2009 that it has finally approved the last revisions on the guide it will give to advertisers on how to keep endorsements and testimonials in compliance with the FTC Act. The guide will affect Advertisers, Bloggers, and Celebrity endorsers. It will take effect on December 1, 2009.

The guide was last updated in 1980.  In that guide a consumer who conveys results with use of a product must clearly define the expected results.  In the old guide they could simple say “results not typical.”
